{"id":17,"date":"2022-06-13T02:37:30","date_gmt":"2022-06-13T02:37:30","guid":{"rendered":"https:\/\/iado.id\/h\/?page_id=17"},"modified":"2024-07-29T17:11:15","modified_gmt":"2024-07-29T10:11:15","slug":"tue","status":"publish","type":"page","link":"https:\/\/iado.id\/h\/index.php\/en\/tue\/","title":{"rendered":"TUE"},"content":{"rendered":"\n<div style=\"height:150px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h1 class=\"wp-block-heading alignfull has-text-color has-background\" style=\"color:#00d10a;background-color:#ccdb7b\">&nbsp;Athlete\u2019s Therapeutic Use Exemption Process<\/h1>\n\n\n\n<h2 class=\"wp-block-heading alignfull has-vivid-green-cyan-color has-ast-global-color-4-background-color has-text-color has-background\">WHAT IS A THERAPEUTIC USE EXEMPTION (TUE)?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-text-align-left\">Athletes may have illnesses or conditions that require them to take medications or undergo procedures. If the medication or method an athlete is required to use to treat an illness or condition is prohibited as per the World Anti-Doping Agency\u2019s (WADA) <a href=\"https:\/\/www.wada-ama.org\/en\/prohibited-list\">Prohibited List<\/a> , a TUE may give that athlete the authorization to use that substance or method while competing without invoking an anti-doping rule violation (ADRV) and applicable sanction. Applications for TUEs are evaluated by a panel of physicians the TUE Committee (TUEC).<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>NADO TUEs are only valid for national-level Competition and Out-of-Competition Testing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignfull has-vivid-green-cyan-color has-ast-global-color-4-background-color has-text-color has-background\">WHAT ARE THE CRITERIA FOR GRANTING A TUE?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>All of the four following criteria must be met (for more details, please refer to the <a href=\"https:\/\/www.wada-ama.org\/en\/resources\/world-anti-doping-program\/international-standard-therapeutic-use-exemptions-istue#resource-download\">WADA International Standard for Therapeutic Use Exemptions (ISTUE) Article 4.2<\/a>):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The athlete has a clear diagnosed medical condition, which requires treatment using a prohibited substance or method;<\/li>\n\n\n\n<li>The therapeutic use of the substance will not, on the balance of probabilities, produce significant enhancement of performance beyond the athlete\u2019s normal state of health;<\/li>\n\n\n\n<li>The prohibited substance or method is an indicated treatment for the medical condition, and there is no reasonable permitted therapeutic alternative<em>;<\/em><em><\/em><\/li>\n\n\n\n<li>The necessity to use that substance or method is not the consequence of the prior use (without a TUE), of a substance or method which was prohibited at the time of use.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading alignfull has-vivid-green-cyan-color has-ast-global-color-4-background-color has-text-color has-background\">WHO SHOULD APPLY FOR A TUE? WHERE AND WHEN TO APPLY?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>Athletes who are subject to anti-doping rules would need a TUE to take a prohibited substance or use a prohibited method. You should verify with <strong>Indonesia Anti Doping Organization (IADO)<\/strong> to know to whom you need to apply and if you can apply retroactively.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>First, check if the required medication or method you intend to take or use is prohibited as per the WADA Prohibited List (<a href=\"https:\/\/www.wada-ama.org\/en\/prohibited-list\">The Prohibited List) <\/a><em>.<\/em> Other references eg. <a href=\"https:\/\/www.globaldro.com\/Home\"><em>globaldro.com <\/em><\/a><em>.<\/em><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>You have a responsibility to inform your physician(s) that you are an Athlete bound to anti-doping rules. You and your physician(s) should check the <a href=\"https:\/\/www.wada-ama.org\/en\/prohibited-list\">Prohibited List<\/a> for whatever substance\/method you are prescribed. If the substance\/method is prohibited, discuss non-prohibited alternatives, if there are none, apply for a TUE. Remember athletes have the ultimate responsibility. Contact IADO if you are having difficulties.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Then, contact <strong>IADO <\/strong>to determine your competition level and TUE application requirements<strong>.<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>If it is determined that you are a National-Level Athlete<\/strong>, [The National Athletes are athletes who are registered in the National Sport Federation and compete to represent their region in National Sport Federation-Organized Events. For Example: National Sports Day (PON)], you must apply to <strong>IADO <\/strong>&nbsp;in advance, as soon as the need arises, unless there are emergency or exceptional circumstances.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>For substances prohibited in-competition only, you should apply for a TUE at least 30 days before your next competition. Please refer to the section \u201cHow to apply to <strong>IADO &nbsp;<\/strong>for a TUE?\u201d below.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>If your level is lower than the \u201cNational-Level\u201d as defined above<\/strong>, [The Lower Level Athletes are Athletes who are registered in the Regional Sport Federation and compete in the Province Competition organized by National Sport Federation. For Example: National Championship (KEJURNAS), Regional Championship (KEJURDA) and so on], you are entitled to apply for a retroactive TUE after being tested by <strong>IADO<\/strong> or any other Anti-Doping Organization (ADO).<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Important note<\/strong>:<\/p>\n\n\n\n<p>A TUE granted by <strong>IADO <\/strong>&nbsp;is only valid at the national level. If you are, or become an International-Level Athlete, or compete at Major Games, that TUE will not be valid unless it is recognized by the relevant International Federation (IF) or Major Event Organization (MEO). It is your responsibility to check if your <strong>IADO<\/strong>\u2019s TUE is automatically recognized by such IF or MEO.<\/p>\n\n\n\n<p><strong>IADO<\/strong> can assist you in the determination of your level and TUE application requirements, and, should the need occur, assist you in presenting your <strong>IADO<\/strong>\u2019s TUE to an IF or MEO for recognition. Please contact <a href=\"mailto:iado.tue@gmail.com\">tue@iado.id<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignfull has-vivid-green-cyan-color has-ast-global-color-4-background-color has-text-color has-background\">CAN I GET A RETROACTIVE TUE?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>You may only apply retroactively for a TUE to IADO if:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>You required emergency or urgent treatment of a medical condition.<\/strong><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>There was insufficient time, opportunity or other exceptional circumstances that prevented you from submitting the TUE application, or having it evaluated, before getting tested.<\/strong><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>As per our anti-doping rules (IADO) you were not permitted or required to apply in advance for a TUE.<\/strong><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>You are a lower level athlete who is not under the jurisdiction of an International Federation or National Anti-Doping Organization and were tested.<\/strong><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>You tested positive after using a substance Out-of-Competition that was only prohibited In-Competition (for example glucocorticoids). <\/strong><\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>In rare and exceptional circumstances and notwithstanding any other provision in the ISTUE, <\/strong>you may apply for and be granted retroactive approval for a therapeutic use of a prohibited substance or method, if considering the purpose of the Code, it would be manifestly unfair not to grant a retroactive TUE.<\/p>\n\n\n\n<p>This unique retroactive TUE will only be granted with the prior approval of WADA (and WADA may in its absolute discretion agree with or reject the <strong>IADO<\/strong>\u2019s decision).<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Important note<\/strong>:<\/p>\n\n\n\n<p>Using a prohibited substance or method without a TUE could result in an Anti-Doping Rule Violation.<\/p>\n\n\n\n<p>In case an application for a retroactive TUE is necessary following sample collection, you are strongly advised to have a medical file prepared and ready to submit for evaluation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignfull has-vivid-green-cyan-color has-ast-global-color-4-background-color has-text-color has-background\">HOW TO APPLY TO IADO FOR A TUE?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-link-color wp-elements-c4c3221230d67e8aea0923af00bd06a2\"><strong>IADO<\/strong> encourages to submit TUE applications via ADAMS, together with the required medical file. If you do not have an ADAMS account yet, please contact <a href=\"mailto:tue@iado.id\">tue@iado.id<\/a> &nbsp;to have it set up.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Otherwise, please download the <strong>IADO<\/strong>\u2019s TUE ApplicationFor<a href=\"https:\/\/iado.id\/h\/wp-content\/uploads\/2024\/01\/IADO-TUE-APPLICATION-FORM.pdf\">m <strong>(<\/strong><em>IADO TUE Application Form )<\/em>,<\/a> and once duly completed and signed, send it together with the required medical file to : <a href=\"mailto:tue@iado.id\">tue@iado.id<\/a> or via Post to IADO Secretariat at FX Plaza Office Tower 15<sup>th <\/sup>floor, Jl. Jenderal Sudirman, Jakarta Pusat, 10270<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Your TUE application must be submitted in a legible form using capital letters or typing.<\/p>\n\n\n\n<p>The medical file must include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A comprehensive medical history, including documentation from the original diagnosing physician(s) (where possible),<\/li>\n\n\n\n<li>The results of all examinations, laboratory investigations and imaging studies relevant to the application.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><em>[Provisions in relation to costs incurred for the completion of TUE, i.e. at the responsibility of the Athlete, including any required additional medical examinations, tests, imaging studies, etc.]<\/em><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Any TUE application that is not complete or legible will not be dealt with and will be returned for completion and re-submission.<\/p>\n\n\n\n<p>To assist you and your doctor in providing the correct medical documentation, we suggest consulting the WADA\u2019s <a href=\"https:\/\/www.wada-ama.org\/en\/search?q=Checklists%20for%20TUE%20Applications&amp;filters%5Bcontent_type%5D%5B%5D=%22resource%22\">Checklists for TUE applications<\/a> for guidance and support during the TUE application process, and <a href=\"https:\/\/www.wada-ama.org\/en\/search?q=TUE%20Physician%20Guidelines&amp;filters%5Bcontent_type%5D%5B%5D=%22resource%22\">Medical Information to Support the Decisions of TUECs<\/a> for guidance on specific common medical conditions, treatments, substances, etc.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Keep a complete copy of the TUE application form and all medical information submitted in support of your application, and proof that it has been sent.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignfull has-vivid-green-cyan-color has-ast-global-color-4-background-color has-text-color has-background\">WHAT HAPPENS AT MAJOR EVENTS?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>A Major Event Organization (MEO) requires athletes to apply for the recognition of their TUE if they wish to use a prohibited substance or method in connection with the Event.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>If you have a TUE granted by <strong>IADO <\/strong>and you will be competing at a Major Event e.g., the Olympic Games, you should contact the MEO for information on their recognition process.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignfull has-vivid-green-cyan-color has-ast-global-color-4-background-color has-text-color has-background\">WHEN WILL I RECEIVE A DECISION ON MY TUE APPLICATION?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>IADO<\/strong>\u2019s TUEC\u2019s must render a decision as soon as possible, and usually within 21 days from the date of receipt of the complete TUE application, including the required medical information.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignfull has-vivid-green-cyan-color has-ast-global-color-4-background-color has-text-color has-background\">WHAT IF I NEED TO RENEW MY TUE?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>Each TUE has a specific duration, at the end of which it expires automatically. Should you need to continue to use the prohibited substance or method, it is your responsibility to submit a new application for a TUE with updated medical information ahead of the expiry date, so that there is sufficient time for a decision to be made prior to the expiry of the current TUE.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Important note:<\/strong><\/p>\n\n\n\n<p>The presence (following sample collection), use, possession or administration of the prohibited substance or method shall be consistent with the terms of your TUE. Therefore, if you require a materially different dosage, frequency, route or duration of administration, you should contact IADO<strong>,<\/strong> as you may be required to apply for a new TUE. Some substances and dosages, e.g. insulin, are often modified during treatment and these possible fluctuations should be mentioned by the treating physician in the TUE application and would usually be accepted by the ADO TUEC.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignfull has-vivid-green-cyan-color has-ast-global-color-4-background-color has-text-color has-background\">WHAT IF MY IADO\u2019S TUE APPLICATION IS DENIED?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>A decision to deny a TUE application includes a written explanation of the reason(s) for the denial. If it is not clear to you, please contact <strong>IADO <\/strong>to understand exactly why the TUE was denied. Sometimes, there may be a critical piece of information, diagnostic test, laboratory results missing, etc. In which case, you should re-apply to us. Otherwise, you may appeal the denial decision as follows:&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\" style=\"list-style-type:1\">\n<li>In cases where the national athlete who objected to the TUE form was rejected, the athlete may send a letter to the IADO to appeal.<\/li>\n\n\n\n<li>As a follow-up to this appeal, IADO will establish a TUE Appeals Body whose members consist of 3 independent Specialists.<\/li>\n\n\n\n<li>The decision of the TUE Appeals Body is final and reported to the Athletes &amp; ADAMS.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading alignfull has-vivid-green-cyan-color has-ast-global-color-4-background-color has-text-color has-background\">WHAT IF MY IADO\u2019S TUE IS NOT RECOGNIZED BY MY INTERNATIONAL FEDERATION?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>You or IADO<\/strong> have 21 days to refer the matter to WADA for review after notification of the non-recognition. If the matter is not referred to WADA for review, <strong>IADO <\/strong>must determine whether the original TUE that was granted should remain valid for national-level Competition and Out-of-Competition Testing. <strong><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading alignfull has-vivid-green-cyan-color has-ast-global-color-4-background-color has-text-color has-background\">WILL MY MEDICAL INFORMATION BE TREATED IN A CONFIDENTIAL MANNER?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>All the information contained in a TUE application including the supporting medical information, and any other information related to the evaluation of your TUE request is kept strictly confidential and treated in accordance with the Athlete\u2019s Declaration contained in the ADAMS TUE process <em>and in the <\/em><strong>IADO<\/strong>\u2019<em>s TUE Application Form  <\/em><a href=\"https:\/\/iado.id\/h\/wp-content\/uploads\/2024\/01\/IADO-TUE-APPLICATION-FORM.pdf\"><strong>(<\/strong><em>IADO TUE Application<\/em><\/a><em> <\/em><a href=\"https:\/\/iado.id\/h\/wp-content\/uploads\/2022\/06\/IADO-TUE-Application-Form-.pdf\"><em>Form ).<\/em><\/a><em> <\/em>All members of the TUEC and any other authorized recipients of your TUE request and related information (as described in the Athlete\u2019s Declaration) are subject to a professional or contractual confidentiality obligation.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Please review the terms of the Athlete\u2019s Declaration carefully.
