Announcement of the Sanction of Doping Case Imposed to a Cycling Athlete

After previously it was announced on April 4th,  2024 IADO stated that there was a bodybuilding athlete who had been declared doping, today of May 22nd, 2022 IADO was forced to again announce the doping case imposed on a cycling athlete in the name of Mr. Odie Purnama Setiawan. Finally, on April 26th,  2024 IADO sent a letter containing its decision to the athlete concerned. Based on the letter, the athlete had the right to appeal up to 21 days after receiving the decision letter. However, as of May 17th,  2024, no appeal was submitted by the athlete, so as of May 18th,  2024 the decision has permanent legal force.

IADO therefore provides through this website the following press release:

  1. The case began on August 23rd,  2023 when the DCO (Doping Control Officer) of IADO was invited by the Indonesia Cycling Federation to collect samples at the 2023 National Cycling Championships and at the same time as the Qualification Round for the 2024 National Sports Games. The National Championship took place in Lubuklinggau (Southern Sumatera) where IADO assigned 4 DCOs and 4 Chaperones. The details are as follows: the number of samples collected was 16, consisting of 8 samples for the Road Race category and 8 other samples for the MTB (Mountain Bike) category. For TTT Men Elite, the first champion was won by Mr. Odie Purnama / Mr. Aiman ​​Cahyadi from Yogyakarta, the second one was by Mr. Rian Setiawan / Mr. Qoiru Alfi from Lampung, and the third one was by Mr. Andri Romadon / Mr. Usahnah Hilmi from Lampung.
  2. As a follow-up to the sample collection, the samples were immediately sent to the WADA-accredited Anti-Doping Laboratory in Bangkok and were received by the laboratory on August 31st, 2023.
  3. In its development, on October 4th, 2023 the laboratory provided the results of the analysis of sample A, whose discovery consisted of Adverse Analytical Findings (MF) in the form of stanozolol metabolites 3′-hydroxy-stanozolol, 4ß hydroxystanozolol, 16J3-hydroxy-stanozolol. For information, Stanozolol metabolites 3′-hydroxy-stanozolol, 4ß-hydroxystanozolol, 16J3-hydroxy-stanozolol are metabolites of the substance stanozolol which is classified in category S 1. Anabolic Agents on the 2023 List of Prohibited Substances. This substance is a kind of substance that does not appear naturally in the body and is included in the group of non-specified substances.
  4. IADO sent an Initial Notification to the athlete on November 8th, 2023, and then IADO received a response from the athlete on November 14th, 2023 regarding the explanation of IADO’s findings.
  5. After that, IADO sent a letter of demand to the athlete on December 7th, 2023. IADO gave the athlete a deadline to respond to the letter of demand no later than December 28th, 2023. Furthermore, on December 23rd, 2023 IADO received a reply from the athlete, choosing to provide a written explanation to IADO and ignoring the right to attend a hearing.
  6. Several important points emerged from that case: a. in his explanation via email as of November 12nd,  2023 it was stated that the athlete admitted to having consumed supplements containing prohibited substances; b. the athlete has only had his sample taken for a doping test once; c. the athlete apparently completed the ADEL module as of April 18th,  2023; d. the athlete did not know that the supplement was a Prohibited Substance; and e. the athlete admitted that he had been negligent in consuming the supplement, so that it was found to be a prohibited substance when tested in a Bangkok laboratory.
  7. IADO charged the Athlete on the basis of  2 anti-doping violations: The presence of a prohibited substance as provided for in Article 2.1 of the 2021 World Anti-Doping Code; and Use of prohibited substances as regulated in Article 2.2 of the 2021 World Anti-Doping Code.
  8. Because the violation involved a non-specific substance, based on Article 10.2.1.1 of the 2021 World Anti-Doping Code the penalty for the athlete is 4 years unless the athlete can prove that the anti-doping violation was unintentional. Based on this article, the burden of proof is on the athlete.
  9. However, considering that the athlete was notified by IADO on November 8th, 2023 and provided a response containing a confession on November 14th,  2023, the athlete is entitled to a 1 year of reduction in his sentence based on Article 10.8.1 of the 2021 World Anti-Doping Code, in means that there is a reduction of  1 year from the maximum sentence that can be imposed on an athlete, so that as a result the sentence for the athlete will be 3 years.
  10. Therefore, the athlete’s sports competition results from the date of sampling, namely 23 August 2023 until the start of the prohibition period for participation, namely 16 April 2024 are disqualified. In. addition, all medals, points or prizes obtained during that period are declared to be revoked. The prohibition period has  taken effect from April 16th, 2024 to April 15th, 2027.

Furthermore, referring to the provisions in the World Anti-Doping Code, especially on the basis of Article 14.3.2, Article 14.3.3, Article 14.3.4 and Article 14.3.5, IADO on May 18th,  2024 has sent a letter to the Chairman of the Indonesia Cycling Federation / ISSI regarding notification of plans to publish sanctions on athletes affected by doping. NADO’s obligation to make public announcements (such provision is regulated in Article 14.3.2 and Article 14.3.3 of the Code) by firstly requesting approval from the athlete or its national federation (regulated in Article 14.3.4) and announced via the website (regulated in Article 14.3.5). In his response, the Secretary General of ISSI answered in a letter of May 22nd, 2024 which essentially gave approval to IADO to announce it via the IADO website.

IADO is very careful in announcing doping sanctions because it concerns the future interests of the athletes concerned (including seeking approval from its national federation concerned), so that only certain matters are presented in the announcement (this is only general matters extracted from the investigation report). However, IADO would also be regarded to violate the regulation by WADA if it does not announce it.

The hearing process (but in that case this right is not used by the athlete concerned) and if there is an appeal hearing (this is also not used by the athlete) which is carried out by the RM Committee and the Independent Appeals Board (if there is an appeal) is carried out completely objectively, because the IADO Management has no right to interfere the authority of the RM Committee as an independent committee and an Independent Appeals Board.

IADO will continue increasing its intensity so that potential doping violations can be minimized and even eliminated as far as possible through various educational efforts and special explanatory approaches, because in fact doping cases can occur not because they have consumed prohibited substances, but because they refuse to have samples taken, are unwilling contacted by IADO about his status and/or provoked other athletes to refuse sampling and so on as regulated in Article 2.1 to Article 2.11 of the World Anti-Doping Code.

Through this press release, IADO reminds all national federations whose athletes have been affected by doping not to try to carry out activities related to their sporting function as long as sanctions are in effect involving the athlete concerned. Included in this context is to participate in any official and / or unofficial exhibitions or matches which are supported directly or indirectly by their own national federation or simply serving as a coach for a club. If a violation occurs, IADO considers giving a warning or adding sanctions.
